Effective date: 12 October 2026
These Terms of Service (Terms) apply to the public website and online services provided by Nketsia 1 Foundation (the Foundation, we, us or our), including information about our programmes and projects, donation and pledge forms, volunteer applications, event registration, newsletters, accounts and member features (together, the Services). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the parts of the Services to which the Terms apply.
1. About the Foundation and these Terms
The Foundation is a non-profit organisation working with communities through four programme areas: Education, Sports, Social Outreach and Elderly Care. Activities such as health screenings may be delivered within Social Outreach. Information about our activities is provided for public awareness and participation. Some features may have additional instructions, eligibility requirements or notices, which apply alongside these Terms.
If a specific programme, event, donation arrangement or written agreement contains terms that conflict with these Terms, the specific terms will apply to that activity to the extent of the conflict.
2. Eligibility and accounts
You must provide information that is accurate, current and complete when you submit a form or create an account. Please update information when it changes. Do not impersonate another person, create an account using someone else's details without authority, or misrepresent an affiliation with the Foundation.
Keep your sign-in credentials private and use your account only for legitimate purposes. You are responsible for activity carried out through your account, except where applicable law provides otherwise. Contact us promptly if you believe your account has been accessed or used without your permission. Available sign-in methods may include Google sign-in. Using a sign-in provider is for authentication and does not, by itself, authorise the Foundation to access content in your other accounts or services. Any future feature requesting access to data through a third-party API will be described separately and will require the relevant authorisation before that data is accessed.
We may correct, restrict or suspend access where reasonably necessary to protect users, uphold safeguarding requirements, investigate suspected misuse, comply with law or maintain the integrity of the Services. Where appropriate and lawful, we will provide an explanation and an opportunity to resolve the issue. You may stop using the Services at any time and may request account deletion as described in our Privacy Policy.
3. Acceptable use
You agree not to:
- break the law, infringe another person's rights, harass others or submit threatening, fraudulent or deceptive content;
- attempt to access accounts, records, features or information that you are not authorised to access;
- interfere with the availability or normal operation of the Services, or introduce malicious code;
- collect, copy or disclose another person's personal information without a lawful basis or appropriate permission;
- use the Services to send unsolicited promotions, spam or misleading fundraising requests;
- submit content that violates confidentiality, safeguarding, privacy, copyright or other legal obligations; or
- misrepresent a donation, volunteer placement, partnership, project result or official relationship with the Foundation.
We may review reports of suspected misuse and take proportionate action where necessary. Nothing in this section prevents lawful activity or the exercise of rights that cannot be restricted by contract.
4. Information on programmes, projects and impact
We aim to present programme descriptions, project records, impact figures, financial summaries and reports responsibly. Information may be updated as project information is received, checked or corrected. Figures identified as provisional, estimated or illustrative should not be treated as final verified results.
Website content is provided for general information and does not constitute a guarantee that a particular programme, project, target, location, schedule or outcome will remain unchanged. If you identify a material error, please contact us so we can review it.
5. Donations, pledges and fundraising
Submitting a donation or pledge form records an expression of intent to give; it does not by itself transfer money or constitute confirmation that a payment has been received. The current donation process records pledges for follow-up, and a contribution is not complete until the Foundation confirms the arrangement and any required payment has been received through an agreed method.
Please provide accurate contact details and donation instructions. Do not include card numbers, security codes, passwords or other payment credentials in website messages or general enquiry forms. Any payment method offered to you will be subject to its applicable terms and any separate instructions supplied by the Foundation or payment provider.
We will make reasonable efforts to apply a contribution to the programme or project you select. If a designated project becomes fully funded, is delayed, cannot proceed or cannot lawfully accept the gift, we will contact you where reasonably possible to discuss an appropriate alternative or return of the gift. The handling of any refund depends on the circumstances, the payment method, applicable law and any specific written donation terms.
Do not fundraise in the Foundation's name, use its branding to solicit contributions, or represent that you are collecting money on its behalf unless you have prior written authorisation. We may decline or return a contribution where required by law or where accepting it would conflict with our charitable purpose, safeguarding obligations or applicable policies.
6. Volunteer applications and participation
Submitting a volunteer application does not guarantee acceptance, a placement, employment or reimbursement of expenses. Applications may be assessed against programme needs, skills, availability, references, eligibility and safeguarding requirements. We may request further information where appropriate.
Accepted volunteers must follow the instructions, code of conduct, safeguarding guidance and reasonable directions provided for their activity. A placement may be changed, paused or ended where programme needs, safety, conduct or eligibility require it. Any paid role or separate contractual relationship must be set out in a separate written agreement.
7. Events and registrations
Event details, eligibility, capacity, location and timing are described in the relevant event notice. A registration is subject to confirmation and available capacity. Please notify us if you cannot attend. We may update, postpone or cancel an event where reasonably necessary, including for safety, operational or circumstances beyond our control, and will make reasonable efforts to notify registered attendees.
Participants must follow event instructions and respect the safety, privacy and dignity of others. Registration does not authorise the use of another participant's contact details, image or personal story.
8. Newsletters and communications
If you subscribe to our newsletter, we may send Foundation updates, programme news, event notices and reports consistent with your subscription and applicable law. You can unsubscribe using the available unsubscribe mechanism or contact us. We may still send essential messages about a request, registration, donation pledge or account activity where necessary.
9. Intellectual property and submitted content
Unless stated otherwise, the Foundation's original text, visual identity, logos, photographs, reports, graphics and other materials are owned by or used with permission of the Foundation or the relevant rights holder. You may link to public pages and quote reasonable short extracts for non-commercial informational purposes with clear attribution, provided you do not misrepresent the material or imply endorsement. Other reproduction, commercial use or adaptation requires permission from the rights holder. Public visibility does not make a photograph free to reuse. Do not republish, sell, redistribute or use Foundation photographs in commercial or promotional materials without prior written permission from the relevant rights holder, unless an applicable legal exception clearly applies. Please see our Photo and Image Use Policy to request permission or report suspected misuse.
You retain rights you already hold in content you submit. By submitting content for a particular enquiry, application, story or programme, you allow us to use it as reasonably necessary to review the submission, respond to you and administer the relevant activity. We will not treat a private submission as permission to publish it publicly. Public use of identifiable stories, photographs or testimonials requires an appropriate lawful basis and relevant consent or authorisation.
Do not submit material you do not have the right to share, confidential information belonging to another person, or sensitive information that is not needed for the purpose of the form.
10. Privacy and third-party services
Our Privacy Policy explains what personal information may be collected, how it is used and shared, how long it is retained, and the choices available to you. Please read it before submitting personal information. Where a feature asks for separate consent or authorisation, that decision will be presented separately when required.
The Services may link to external websites or rely on third-party services for features such as account authentication, communications or embedded content. Those services may have their own terms and privacy notices. We do not control third-party websites and are not responsible for their independent content, availability or practices. Review their notices before using them.
11. Service availability and changes
We work to keep the Services useful and available, but we do not guarantee uninterrupted, error-free or continuous access. Features, content and availability may change, be temporarily suspended for maintenance, or be discontinued where reasonably necessary. We will take reasonable steps to avoid unnecessary disruption, but advance notice may not always be possible.
12. Disclaimers
To the extent permitted by law, the Services and their general informational content are provided on an "as available" basis. We do not warrant that every page will always be complete, current, uninterrupted or suitable for every purpose. Nothing in these Terms excludes a promise, duty or consumer right that applicable law does not permit us to exclude.
13. Limitation of liability
To the extent permitted by applicable law, the Foundation will not be liable for indirect or consequential loss arising from ordinary use of the Services, including loss caused by temporary unavailability or reliance on general informational content. This clause does not exclude or limit liability for fraud, wilful misconduct, death or personal injury where exclusion is prohibited, or any other liability that cannot lawfully be excluded or limited.
14. Suspension and termination
You may stop using the Services at any time. We may suspend or end access to a feature or account where reasonably necessary for legal compliance, safeguarding, prevention of misuse, protection of users or the operation of the Services. Where appropriate and lawful, we will explain the reason and any available review process. Provisions that by their nature should continue, including provisions concerning intellectual property, privacy, liability and unresolved obligations, will continue to apply.
15. Changes to these Terms
We may revise these Terms to reflect changes to our activities, features or legal obligations. The current version and its effective date will be published on this page. Material changes will be highlighted or communicated where appropriate or required by law. Your continued use of the Services after updated Terms take effect means the updated Terms apply to your subsequent use, subject to any consent requirements imposed by law.
16. Applicable law and general provisions
These Terms are subject to the laws applicable to the Foundation's operations, including applicable laws of Ghana where relevant, and mandatory consumer or other protections that apply to you. Nothing in these Terms removes a right that cannot lawfully be waived. If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision is not a waiver of the right to enforce it later.
